1. Right of withdrawal

If you are a consumer and make a distance purchase, you generally have 14 consecutive days to terminate the contract without stating a reason, under Decree-Law No. 24/2014.

The period generally runs from the day on which the consumer, or a third party indicated by the consumer other than the carrier, takes physical possession of the goods, without prejudice to the specific rules applicable to multiple deliveries.

2. How to exercise this right

To exercise the right, you must communicate an unequivocal statement to:

You may use the withdrawal form template provided by INOVACRIL, although its use is not mandatory.

3. Returning the goods

After communicating the withdrawal, the consumer must return the goods within the applicable legal period.

Unless otherwise indicated in writing by INOVACRIL, goods must be returned to:

Prior contact to comercial@inovacril.pt is recommended, stating the order number, so that the return can be tracked.

The consumer should keep proof of shipment.

4. Return costs

The direct costs of returning the goods are borne by the consumer, unless INOVACRIL has offered to bear them or the law provides otherwise, namely in cases of non-conformity of the goods.

This information is provided before the purchase, as legally required.

Where the goods are defective or non-conforming, the return costs are not borne by the consumer.

5. Refund

Where the right of withdrawal is validly exercised, payments due will be refunded under the law, including, where applicable, the cost of the least expensive standard delivery method offered by INOVACRIL.

The refund will be made within the legal period and may be withheld until the goods are received or the consumer provides proof of return, where legally permitted.

The refund will generally be made using the same payment method, unless expressly agreed otherwise and provided the consumer does not incur any costs.

6. Condition of the goods

The consumer may handle and inspect the goods to the extent necessary to establish their nature, characteristics and functioning.

The consumer may be liable for any diminished value resulting from handling beyond what is necessary for that verification, as provided by law.

7. Exceptions

The right of withdrawal may not apply in the situations provided for by law, including:

• goods manufactured according to consumer specifications;
• clearly customised goods;
• other cases provided for in the applicable article of Decree-Law No. 24/2014.

INOVACRIL must clearly state the applicable exception before the purchase.

Important: a standard product with normal catalogue variants should not automatically be classified as customised.

8. Defective or non-conforming products

The right of withdrawal is distinct from the rights relating to non-conformity.

If goods are non-conforming, the consumer benefits from the rights provided for in Decree-Law No. 84/2021, including, depending on the case and legal conditions, repair, replacement, price reduction or termination of the contract.

Notification should be sent to comercial@inovacril.pt, stating the order number, a description of the problem and, where useful, photographs.

9. Legal warranty

The sale of goods to consumers is subject to the legal conformity regime. For new movable goods, the trader is generally liable for non-conformities that become apparent within the legal period currently set at three years from delivery, without prejudice to the specific rules of the relevant law.

Any additional commercial warranty does not reduce the rights under the legal warranty.

10. B2B orders

The withdrawal rules intended for consumers generally do not apply to purchases made exclusively within the scope of professional/business activity. In such cases, the agreed commercial conditions and corresponding legislation apply.
